Legal Question in Family Law in New York
where does the line get drawn
My mother passed in 2004 to my knowledge all went to step dad of 10 years-no will. Recently he has passed and I went home to collect the family dog. At that time I was aleted that Mom did have a will which I have never seen and he apparently has one as well. Rumor has it that I am 50% but step sis has staked claim of all including my mothers documents address book etc. When I left with the little ankle biter I took a couple paintings and some odds and ends asking that she please mail my mothers docs to me. Apparently she came up minus MY MOTHERS camera and thinks I have it because all I have received is the instructions to it with a comment written. Anyway how do I get a copy of a will I know exists. Aren't they generally recorded upon execution? Would the attorney release a copy of my mothers to me being I am the sole survivor? She also had a pention that went into a bank account that I thought I was simply a signer of but I was a co-owner is it possible that he set it that way and passed it off as a 50/50 between he and I? Last but not least how would I go about finding life insurance polocies safe deposit boxes of my mothers? She worked way to hard for the step sis to squash.

Re: where does the line get drawn
No wills are not recorded upon execution. You need to contact any attorney that your mother may have used and you need a very good trusts and estates lawyer in the jursdiction your mother lived in. I would do it Monday and not wait any longer than 9:00 a.m. or you could be out even more.
