Legal Question in Family Law in New York

Live in won't leave

i have been living with my girlfriend for the past five years. as of the last year and a half we have not been getting along at all. four months ago i asked her to leave, i own the house we live in. we have a daughter together and she has two kids by her former boyfriend. thats all we do is fight about everything and i can't take it anymore. what can i do to get her out of my house.

I agree with Mr. Hanlon. Your best course of action is to treat her as a tenant, and present her with a "Notice to Quit." If she does not leave, begin eviction proceedings. You should be able to get all the documents you need at your local housing court, if you live in New York City. Otherwise, call your local justice court and ask for eviction forms.

While she is probably technically a guest

and therefore subject to being thrown out

without notice or process, the wiser

course of action would be to treat her

in the same fashion as a boarder, give

her 30 days notice to leave, in writing, served

before the first of the month. If she

then fails to leave, bring an eviction

proceeding and get a court order
