Legal Question in Family Law in New York
I live in Tonawanda, NY in Erie county and I have been currently separated from my second husband for approximately 15 months - we have been married for 14 years and I will be filing for divorce in the near future. My husband has a lot of monetary assets and means than I do and because of being married to someone with more means I did not have a need to have a separate insuarance policy even though I was diagnosed with M.S. 10 years ago. Up to this point in the separation my husband has not paid any sort of spousal support or provided any sort of insurance coverage. I recently was let go as part of downsizing at my job.
As such, what options do I have to receive some sort of spousal support to help defray my costs that unemployment will not cover? My husband has assets of about $750K including the house we finalized construction on and shared but which he currently resides - the residence is in Middleport, NY - Niagara County. I am not looking for a prolonged legal process but some sort of compensation while I am unemployed and until the divorce is complete as well as some sort of settlement for the time invested in the marriage. Any information would be greatly appreciated.
Thank-you for your time,
Barb Smith

The new statute going into effect in October requires spousal support and assistance for attorney's and legal fees. You want to consult with an attorney now to get things ready.
