Legal Question in Family Law in New York

i live in westchester county ny. in regards to child support. my atty never appealed my court ordered child support. the 30 day appeal time has passed. what are my options? also is he liable for anything?

Before you can get to a question of attorney liability you have to answer two questions.

Did you request that he appeal? Were there grounds for appeal?

As to options, the law sets forth certain grounds for revisiting the amount of child support.

1) A substantial change of circumstances

2) Three years have passed since the order was entered; or

3) There has been a change in either party's gross income by fifteen percent {15%) or more since the order was entererd, last modified or adjusted.
