Legal Question in Family Law in New York

Hello. I live in New York City and have a child support hearing coming up soon. I have no problem paying child support for my 17 year old son son based on my income. However, I am fearful that if I provide my husband's income and inform the court that we split the bills, I will be assessed to pay more child support. Do I have to inform the court that I am married? There is no question indicated on the child support form about marital status. My husband and I married 9 months ago so we did not file taxes together. At this point, I am ready to have him live elsewhere until everything is final because it is not fair that his income could possibly be considered for a child that is not his. I am not trying to be sneaky. I just want to pay based on my income because it is MY son. I have no other children. Your help will be greatly appreciated!

This is a heavy potential liability-you could be paying for the next 4 years (until he graduates from college). Get an attorney for the limited representation on representing you on this issue.
