Legal Question in Family Law in New York

I live in New York and want to get a divorce and move to Florida with my 7 year old. Can my husband stop me from moving out of New York?

Yes, unless he consents to the relocation or a judge finds that it is in the best interests of the child, you will not be moving since you can not interfere with the relationship between your husband and his child. You will need an attorney to give you the best chance to accomplish your goals.

Yes. Generally parents are entitled to have visitation and leaving the state would inherently limit such visitation, as a result a parent woukd generally have to consent for such a move.
