Legal Question in Family Law in New York

I live in New York State. My girlfriend and I are expecting a baby around mid-September. Although we have been together for sometime, she never filed for a divorce or even legal separation from her ex-husband. They both agreed to separation but just never made it legal. With the baby on the way, they will be filing the paperwork shortly. There is no question that I am the father, nor is anyone contesting that fact. Do I need to file a paternity petition, or can I simply fill out the voluntary acknowledgment of paternity at the hospital after the baby is born?

You can simply fill out the voluntary acknowledgment of paternity at the hospital after the baby is born.
