Legal Question in Family Law in New York
My live-in paramour just obtained custody of his two children. Their mother is limited to visitation on saturdays from 10-8. She is a bus driver at the school the children attend. She has been going from the bus garage across the street into the school at times when she knows the children will be in a certain location. i.e. lunch time, free play time, etc. What I would like to know is if she is breaking the court order by doing this? The children become very upset each time she does this as she questions them and tries making them feel guilty. Also, is this something we would be able to get a restraining order against her?

A modification petition should probably be filed informing the court of this. If the court agrees that this is too much for the children, then they would limit her contact based on what is best for the children.
