living together laws in new york city

Do I have any legalm rights after living with the father of my two children for 17 years and we do own a homwe together. can I take him to court for mental abuse.

While NY does not recognize common law marriages, if you own property together you do have certain rights. Moreover, there are domestic violence laws in every state including NY under which your boyfriend may be arrested. If you are looking to exclude him from the home for the aforementioned reasons than try getting an order of protection from the Court but bear in mind that they only work if you call the police when it is being violated. The police cannot protect you if you fail to call them. You also might want to go to the County Supreme Court and file suit for a partition sale of the home which would ask a judge to force the sale of the home and give the proper division based upon need and contribution to the household. They will also take into consideration the ages of your children.
