Legal Question in Family Law in New York

sorry this is long but important please help

I am dealing with a situation my

fiancé's ex girlfriend she lies and is

manipulative her mother is sick with

cancer and has about five years left

she has a baby who is supposedly my

fiance' son we support that but

found out that she cheated on him

with many men we have proof as

well we want paternity test but can't

afford it she wont let him see the

baby mostly out of spite she had

admitted to getting pregnant so that

my fiance would stay in the

relationship we are worried for the

babies safety she has neglected him

and has been rough with him he is

only 2 months we have proof people

are willing to testify in court she is

bipolar and unmedicated and has

said in a instant message

conversation that she would kill the

baby when we confronted her on it

she said it was out of anger (doesn't

matter we are scarred) if the baby is

his we want custody but don't even

know where to begin on how to deal

with this or how to afford this I work

at a kids craft store and don't make

much as well as my fiance we have

enough to get by and very

supportive families right now our

concern is for his son, wether the

baby is his or not we are worried for

the baby's safety

If you are worried about the baby contact Child Protective Services. They will investigate the mother, and if they find the child is in danger your fiance can let the court and the CPS worker he will take the child in.

Also try calling your county bar association to see if they have a pro bono panel and if you qualify for free legal help or call an area law school and see if they sponsor a family law clinic. Though they are not really experienced, the students make up for the lack of experience with a will to work hard and the back up of the law school and its clinic staff.
