Legal Question in Family Law in New York

I lost my job back in october of 2011 and immediately filed for a child support modification. It is July 2012 and I have yet been to court. I am working very part time, keeping my eye open for something better, while i go to school full time. I will be done with school this aug. My ex keeps convienetly post poning court. Thanks to my current wife and with her income and savings we have managed to stay current with the payments until recently (a month or so), there is just no more money!!! We reside in new york and on the website they mention something about an "affifidavit of net worth", fill it out, notirize it and hand it in and it "protects" your liscense from suspension? Anyone heard of this? Also, should we be getting a lawyer at this point? I believe we qualify for "legal aid" but am not quite sure how it works. My child does live in a different county than i do. Any pointers? Thanks

The Net Worth statement is a document used in a divorce case. In a child support case there is a financial affidavit which should be submitted to the court.

However, no affidavit will protect your license from suspension.
