Legal Question in Family Law in New York
maintenance
My husband cheated on me, and I am going to file for a legal separation or divorce. He makes $30K more than me. I also learned that, even though he earns more than I do, he has been depositing less than I have in our joint account. Finally, ''we'' have paid child support payments and related expenses. Is it reasonable to request maintenance? If so, should I make this request as part of a formal separation agreement?

Re: maintenance
There are many issues that need to be resolved when divorcing. This is particularly true in your case.
I would recommend that you consult with an attorney so that you may learn all of your rights and responsibilities.
Re: maintenance
I concur with Mr. O'Donnell. A multitude of factors affect the determination of maintenance, including the spouse's ability to be self supporting, the length of the marriage, etc. Consult with an attorney as soon as possible to discuss your particular situation and devise an appropriate strategy.
