Legal Question in Family Law in New York

Majuskas

What does it mean, in a divorce decree, when referencing dispursement of an ex-husband's retirement plan to his ex-wife, ''...Husband shall transfer to Wife her ''Majuskas'' share of said retirement plans by means of a Qualified Domestic Relations Order.'' Is this something that I (ex-wife) have to apply for?

Re: Majuskas

It is something your lawyer should explain to you. But, it means that the formula for the pension distribution is the formula used in a divorce case called Majuskas.

An Order must be prepared and signed by the Judge that is consistent with a "Majuskas" type of order and then served upon the EX and the Employer for the EX. The Order once entered and Served upon an employer, can ensure that the pension is not disbursed without disbursemen to the spouse entitled to share in the pension.

Good luck,
