Legal Question in Family Law in New York

Marital Debt

My husband and I are recently separated. There are no legal agreements signed or filed at this time...my husband just moved out 6 months ago, just left. I have two children (4 1/2 and 3 1/2). We own a home together and he was advised by a lawyer that he no longer is required to pay the mortgage or taxes associated with the property.

He had been giving--name removed--his paycheck to pay all the bills (I do the bills). He has recently decided to give--name removed--approximately 37% of his pay for child support. (is more than required), but it is not enough to pay the mortgage and taxes.

I want to know, regarding the mortgage, what is his responsibilities (his name is on the bank note too).

Also...I cannot afford a lawyer. If I hire one,

will my husband be required to help pay for my legal fees?

I suggest you speak with an attorney. Depending upon your circumstances, your husband may be required to pay the housing expenses, child support and spousal maintenance. He may be compelled to pay your attorney's fees, as well.
