Legal Question in Family Law in New York

marital problems

MY husband and I are having a lot of problems and this past weekend he hit me hard in the face. We have an 8 yr old son and he was there when this happened. I told my husband he needed to get out but he will not leave. He has agreed to go for marriage counceling but none for just himself. He has a LOT OF ANGRIER issues and has been verbally abusive to both myself, my son and my step sons. How can I get him out for now? Legally, he's in the national guard full time and I don't want to have this affect his job.

Re: marital problems

If your spouse has abused you in front of your children, your children are also being effected.

You need to focus on what is best for the children.

Perhaps Family Counseling will help.

Re: marital problems

No one (NO ONE!) should ever have to be subjected to physical abuse. You should contact the police and file a complaint.
