Legal Question in Family Law in New York

marital property aquired during marriage

I have not done anything legal in regards to a husband who gave me a lot of mental abuse. I have recently moved out of the house and moved in with my son. My husband is selling things in the Want-Ad Digest...a trailer and motorbike we acquired together. Is it legal for him to do this and am I entitled to half of the proceeds??

Re: marital property aquired during marriage

The only way you can stop him from selling household items, or even giving them away is to get a court order.

You have to start an action, probably a divorce action so that a judge could be assigned to look into the matter.

see a lawyer right away. Once the property is sold, it would be very difficult to get your share of the proceeds from him.
