Legal Question in Family Law in New York

marital property

My friend is going through a divorce. His ex-wife was living in the marital home and abandoned it. His lawyer submitted a letter telling her he was now moving in it. She has taken things like the carpet, light switch covers, shelves, cabinets, ceiling fans, put cat liter in the sinks. This is approx. a $350,000 home with about $40,000 worth of damage. They also have 3 rental properties. He is willing to give the rental properties in exchange for the house. Is this a fair deal and can anything legally be done to her for the damage?
