Legal Question in Family Law in New York

Marital Property

My husband left the house in January 2006. He lived with his girlfriend for a while and then a couple other places. Two weeks ago he said he need to get an apartment as he had nowhere to live. I can not afford the house (he stopped making mortgage payments) so I told him he could stay in the house and I would get an apartment as I could afford that. Now he won't let me in the house to get my items and he will not give anything to me. We are not legally seperated. Do I have a right to enter the house?

Yes. But you may have to get a court order to enforce your rights.
