Legal Question in Family Law in New York

marital property in NY

I have been having problems with my current wife, she has a problem with my daughter from a previous marriage coming to visit. She actually left the house with my 4 month old triplets while I was going to pick my daughter up.She took my triplets to her mothers and said that I was man handling my kids just as an excuse to leave.I have been putting up with this for about 6 years and really don't want to deal with her anymore. We have three houses one she had before we were married .I am a contractor and have done repairs on her condo .We also bought a house with her funds and then got married and then Flipped it .I was not married when she first purchased it but was married to her when we sold it.We then bought another house in which I installed new siding windows kitchen bath and then we took a mortgage out on that house and I built a brand new house in which we live in .We rented the other house out so that we didn't have to pay the mortgage. Now since the other house is empty she wants to move out of the new house and sell it .The property is all in her name because problems I had with my last marriage .Do I have any chances of visitation with my children and will I get anything for my hard work that I have put into these properties

Re: marital property in NY

I can see that you have problems with your wife. If the marriage is over, you have the right to seek custody on your own behalf, and you would be entitled to as much visitation as you want. Courts are very liberal when it comes to visitation with your own children.

As with the real property, you would receive an equitable distribution of those properties.

If you did work on those properties during the course of the marriage, you would be entitled to a share of the appreciation of the value of the property.
