Legal Question in Family Law in New York

marital property

I would like to know which part of my checking account will be considered marital property when I file for divorce.

Before getting married I had a checking account on which I received my monthly paycheck and I kept the same one when I got married. Now is the whole account considered marital property or only the amount accumulated during mariage?

Re: marital property

This is an example of 'co-mingling'. because you have not kept the account separate and distict from your earnings during the marriage, the whole account becomes a part of the marital estate.
