Legal Question in Family Law in New York

Marriage without hurting partner with existing financial problems

My significant other and I would like to marry but I have bad credit, a very delinquent student loan, unpaid medical bills, and legal expenses for a continuing child custody battle that I will work many more years to settle. He has a disabled son and has reestablished his credit and paid his debts with years of hard work. Can we marry without my financial problems affecting his hard work to resolve his? Is there any kind of prenuptual agreement to prevent this opposite kind of concern? We aren't concerned with who gets what if we later split up, but how not to hurt each other with the past. Thank you.

Re: Marriage without hurting partner with existing financial problems

I understand your problem. However, a pre-nup probably won't solve it. Think of a pre-nup as a divorce settlement before the marriage even happens. If either or both of you continue to have financial problems after the marriage, the pre-nup won't fix them.
