Legal Question in Family Law in New York

Married with two children. No custody is currently established. Live in New York State, but want to move out of State. Do I need to recieve written consent from the father who is incarcerated or get custody established before I can legally move??

It is best that you obtain legal custody as well as an order from the court allowing you to relocate. Until a court awards custody, neither parent has custody. Although the father is presently incarcerated, he still has rights. Thus to protect yourself, you should obtain the court's permission
