Legal Question in Family Law in New York
Not Married & Concerned
I am an unmarried person who is epecting soon, the mother of the child is giving me a hard time about being part of the child's life. She seems to be using my child against me and at times she threatens to me that she will not let me see my child or she's going to take my child out of the country. I expressed many times that I want to be apart of my child's life regardless if her and I are not together anymore. I would like to know what my rights are as a single unwed father and how can I gain custody of the child if necessary?

Re: Not Married & Concerned
In NY, custody is determined in the child's best interests. You need to be very careful about asserting your (potential) rights as a parent in a way that does not prejudice others (regarding determination of paternity and support obligations). It is very important that you contact an attorney right away, or at least before you do anything or the child is born, to take appropriate steps and to best position yourself to get custody/visitation if, in fact, the child is yours. Feel free to call my office to discuss this further.
