if a married couple with a child splits up can one of the parents move to a different county with the child legally

It depends on the county. If the parent moves from Suffolk County to Buffalo causing major disruption to the child, the answer is no. However, if the parent moves from Suffolk County to Nassau County, a short 30 minute drive, the answer would be yes.
