Legal Question in Family Law in New York

NOT Married and Desiring to Relocate with my daughter

i have a 1 year old girl and i am not married to her father nor have i ever been. i plan to move out of state and am concerned her father could legally prohibit me from doing so. currently the father has no relationship with his daughter, has gone 6 months at a time without seeing her and makes no effort to financially support her. there has been a court order to begin child support in which 3 months have not yielded one single payment. no vistation orders were established during this time. is it true that because he is the father and has established paternity by signing the appropriate paperwork that he could stop me from relocating with her if i make my plans known? please advise.

Yes it is true. However, his being established as the father is not dispositive of your being able to relocative. You should speak with an attorney about filing a relocation peitition in Family court before you just move without court order.
