Legal Question in Family Law in New York

still married?

It has been 15 months since I filed for my divorce. It's been a year since my husband and I signed the stipulation of settlement. I don't understand why it takes so long. I don't have a divorce decree yet but in the stipualtion it said he has to provide health insurance for the kids and life insurance as well. Since I guess the divorce is not final how can that be enforced? With out using my attorney and spending another $6000 what can I do or where can I go to have the health ins & life ins agreements enforced if I even can? All of the papers are filed with the court according to my attorney and we are just waiting for them to come back from the judge (that was months ago).

If you signed the Stipulation a year ago, and are still waiting ...., then something is wrong.

Suggest you invest another $250 for an in-depth consultation with an experienced matrimonial attorney.

You can go to family court to have the separation agreement enforced. You don't need an attorney, and the judges there are used to dealing with people without attorneys. Please call your county courthouse to get more information about your local family court.

Have the "uncontested divorce" papers been filed? Even after you have been apart for a year, additional paperwork needs to be filed with the court to actually obtain the divorce. You should ask your attorney if the paperwork has been filed, and if not, why not.
