Legal Question in Family Law in New York

Want to get married again

I have been seperated from my husband now for 6 years but with no legal seperation document. I met a wonderful man whom I have been dating and he's just proposed. My husband has been living with another woman for 3 years and they've recently had a new baby. I'd like to file for divorce asap and will be getting married in Texas. How long will the whole process take and become final and how long would I have to wait to get married? Texas law says you must bring in a copy of the divorce decree and can't get married till the 31st day after the divorce is final or if the decree says to wait longer?? My husband has agreed to to the divorce. Since my fiance is from Texas we'd like to marry their. I'd really like to wrap this up asap, I'd never thought I'd meet someone again let alone get married or else I would have divorced him alot sooner, my mistake. Please help, thanks!

Re: Want to get married again

Once the uncontested divorce documents are submitted to the court, it depends on how backlogged the court is before a judgment will be signed. In my County, it has been taking about 4-6 wks to recieve the final judgment of divorce.

Also, in NY, someone will have to admit to fault. Such as abandonment. Once you are officially divorced, NY does not require you to wait to get re-married. You may do so the next day.
