Legal Question in Family Law in New York

marrital property

My husband and I just seperated. We own the house together but he chose to leave and leave me with all rights and responsabilits of the home,as well as the children. Does he have the right to reenter ''my'' home without my knowledge or consent when he wants? As well as going through my personal belonings and computer, taking with him things and copies of what he wishes? Nothing has been put into writing as of yet, so what are my rights?

Your rights to limit his access to a property he owns along with you is limited but the first thing I would do is change the locks and possibly get an alarm. I would also file for divorce or at the least see if he wants to enter into a separation agreement but those must be voluntary by both parties.

To further answer your question directly, yes until you take steps to stop him, he can continue these actions.
