Legal Question in Family Law in New York
Marrying a Man with Credit Card Debt
I am considering marrying a divorced man who has $35,000 in credit card debt. He no longer has any assets to sell (house, car). Would I become automatically responsible for his debt by marrying him? I do not have a permanent full-time job due to health issues. I am a freelance editor who works from home and my income is low and not dependable. Also, I will be getting a sizable monetary inheritance from my mother's and aunt's estates when they pass away. I am 50 years old. Could my inheritance be taken to pay his credit card debt if we are married and he becomes unable to work (he is 53 and in good health now)?

Re: Marrying a Man with Credit Card Debt
You need a prenuptial agreement to avoid assuming his prior debts, and to protect your future inheritance. I strongly suggest you consider a "prenup" prior to marrying him.
