Legal Question in Family Law in New York

I am in mediation. My son's father has not filed tax returns in 6 years and owes the irs money, he works under the table for cash as a contractor. He is refusing to pay support more than $200 per month but he earns much more than I do. My son is 16 months and has always lived with me. If we go to court, what can the judge do? The enforcement agency could not help me without a trial because there are no records of any income at all. I am broke and in debt form past medical bills from the baby. Should I take the $200 he is offering? He makes at least twice my wage and based on my wages he would have to pay $500

Please remember that this money is not yours, it is called child support because it belongs to your child and it is his right to be supported by his father. You have to decide how far you want to go to protect your child and temper that with any consequences to yourself. I would sit down with an attorney to represent you individually to get all of the information necessary to make this decision.
