Legal Question in Family Law in New York

Medical History Disclosure

I have a medical condition that I have only spoke to my spouse, parents and in-laws. They have revealed to me that they have talked to others about my situation even though they verbally swore to me they would never tell a soul. I feel violated and humiliated. How is it there right to talk about personal medical history with anyone they want? They tell people I do not know very wel or at all.

Re: Medical History Disclosure

It is apparent that some of your family members have violated your trust. Unfortunately it is almost impossible for you prove damages in such a case, particularly since your family members don't owe you a legal obligation of confidentiality. From the category you posted this message to it seems you are contemplating a drastic step. I will only counsel you that (i) the damage, so much as it is, is already done and cannot be undone and (ii) you can't (though we would all at some time like to) divorce yourself from your family. I'm afraid your only recourse is to tell them that they have broken your trust and you will no longer confide in them. Of course you can divorce a spouse -- but will this really solve the problem? That is a question only you can answer.
