Legal Question in Family Law in New York

medical history

my sons father has sole custody and has taken him for medication for ADHD claiming he shows specific symptoms. The doctor has not taken a medical history of my side of the family and he does not display any symptoms while with me. I suspect that these behaviors are because of emotional stress related to his wanting to live with me and his brother. Can I take action for misdiagnosing him?

Re: medical history

Your first step should be to get a Second opinion of your son's medical and mental condition, after comprehensive testing and examination.

You should also obtain your son's complete medical records and diagnosis, for another doctor to review, to ascertain the treatment your son is currently receiving.

Then decide, with input from the [second] doctor how or whether to proceed.
