Legal Question in Family Law in New York

medical pymts not covered by insurance

My husband divorced his ex 5 yrs ago. They have two kids, 15 and 12. His divorce stipulates that he carries medical insurance for the kids, plus has to pay 96% of all medical pymts outlayed by his ex, that are NOT covered by his insurance. She is extremely unwilling or too lazy to look for a doctor in my husband's plan (United Healthcare!), so we end up eating several hundred dollars a month on all kind of medical expenses for the kids. Is she allowed to do this continuously? This sounds like a license for her to abuse this privlege of ''not covered by insurance''. She has a choice of specialists, but doesn't bother. I'm ready to scream! Please kindly advise... We spoke w/her, but no use.

Re: medical pymts not covered by insurance

Your husb needs to go back to court and petition the judge for an order that she uses doctors within his med plan or she pays for it. This is reasonable.
