Legal Question in Family Law in New York

Minor name change

How would I go about changing my childs last name from mine to my married name after I get married. I was never married before. The biological man is on the birth certificate but was never in the childs life. Can I do this without getting his consent?

Re: Minor name change

Until the child turns 18, a name change

requires the consent of the parents

However, if there has been no contact for

extended periods of time, and there has

been a remarriage, many absentee fathers

consent to an outright adoption because

this terminates their child support obligation.

During such proceedings, the name can be

changed

It also never hurts to ask.
