Legal Question in Family Law in New York

Getting money from spouse when not living together

I got a restraining order against my husband this morning, I am currently staying with my daughter, I cannot work for health reasons. How do I go about getting some type of income from my husband. I cannot afford a lawyer because I do not have any income & he is not giving me any money.

You need to file a Pendente Lite petition. You also need a lawyer. I suggest that you contact the Nassau County Bar Association . They have a Pro Bono panel there which represents people who are poor and involved in matrimonial cases. Good Luck.

You need an attorney because you need to file a Motion for Interim Relief (pendente lite). You should contact a free legal service or your local bar association for pro bono service. If you are unsuccessful then contact me directly and I may be able to help you.
