Legal Question in Family Law in New York

hello my name is monica and i hope that you help me by answering my question

my question is.my husband has a daughter that he has not been able to see. my husband went to court and him and his baby mother did not go threw the court processing but they however. did have a set down with there apointed lawyers and

his daughter as will. and they all came to agreement . that my husband will get his daughter on all holidays and on her birthdays and weekends. however the mother have not been following the agreement @ all.so in making this agreement that the court processing will not go forth.

I am not sure of your question.

Did the court state that a custody/visitation hearing would proceed if the agreement did not work?

Are you asking whether your husband should now file for custody/visitation?
