mortgage payment and separation

how do i get my husband to leave the residence, when he is an alcoholic, non employeed dweller. the mortgage is soley in my name, but the deed is in both.

There is no legal way to get him out of the home while you are still married. It doesn't sound as if there are legal grounds for a "full stay away" Order of Protection. He has legal rights to remain in the home but for the Order of Protection.
