Legal Question in Family Law in New York
My mother has had custody of my brothers daughter since the day she came home from the hospital. She will be 9 this month. My brother has made little to no effort to be in her life even though the current court order grants him liberal but supervised visitation. In the past 8+ years he has only had contact with his daughter a handful of times. Now my mothers financial situation has changed and she sought out help from the department of social services. My brother received court papers today for child support (which he has never been ordered or willingly paid). He in turn filed for soul custody today. I am very worried that as the biological father he will get custody and keep her away from the family out of spite. Is this really possible?

I would strongly urge your mother retain an attorney to represent her to make sure that this does not happen.
