Legal Question in Family Law in New York

moving child to a different country

I have sole custody of my daughter, her father hasnt been involved in her life in a year and a half, we were never married, and doesn't visit, doesnt pay child support, etc. Visits are supposed to be ''as agreed upon''. I want to move to another country with her. How do I go about doing so, legally?

Re: moving child to a different country

1. Since you have legal custody of the child, you have a 100% right to move anywhere you chose.

2. The best way to protect yourself in this situation is to send a statement of your intent to move by certified mail to the father.

Giving him notice is sufficient.

3. You may also ask the court for permission adjust the 'visitation order' by granting permission to move. This is a motion to adjust the visitation order and is used because your move would make the visitation in a manner contemplated by the visitation order impossible.

But 60 days notice by certified mail should be sufficient for your purposes.

Good luck.
