Legal Question in Family Law in New York

Moving during divorce proceedings

I filed for divorce June 10, the divorce is not settling quickly due to some marital debt. Can I move to an area 30 miles away with my son and change his school. I will be renting rooms in a home from a good friend who also lives there. There is no custody fight in this divorce, could this start one?

Re: Moving during divorce proceedings

Thirty miles is certainly not an unreasonable distance to move - however - you should consider the move in light of the other logistics in the case. The most prudent course of action would be to consult with your attorney so that he/she may determine this issue in light of all of the facts and circumstances with special consideration to what stage in negotiations you have reached. Good luck!

What does your attorney say about this?

It is best to discuss these issues with your attorney before they occur.

If you are not comfortable with your attorney's advice, suggest you seek a second opinion from an experienced matrimonial attorney.
