Legal Question in Family Law in New York

Moving out of state with a child

My 18 yr. old sister has a 5 mo. old baby and currently lives in NY but wants to move to PA. She is not married to the father of the baby, he does not currently pay child support, and he hardly ever sees his child. He is also on probation for some crime and cannot leave the county in which he resides (along with the fact that he has no driver's license are reasons why he claims not to visit his daughter). What steps must my sister take to make this transition as smooth and as legal as possible?

Re: Moving out of state with a child

You asked about relocating with a custodial child.

You have not presented enough facts to provide clear direction. If there is no custody order then there is generally no bar on the custodial parent's relocation. If there is a custodial order then it would have to be reviewed and possibly modified before a custodial parent could relocate.

Contact an attorney in the locale where the child is presently located for proper advice.

Regards,

Roger
