Legal Question in Family Law in New York
Moving out of State
My girlfriend and I want to move out of state but we kind of hit a roadblock. We were told by a few people that we HAVE to tell the father of her daughter we were moving and when we did so he told us would could not move and that he has parental rights. I've been with my girlfriend since her daughter was 11 months old and she is now going on 3 years old and he has only seen her about 5-6 times and we have seen about 14 dollars from him to support her. He has threatened us with court dates since we told him we were moving. Because we didn't know what to do for sure we have stopped packing and have put our plans on hold and have filed a petition to modify the sole custody order with the court. In the meantime is there anything else we can do that can move this along sooner so we can move or do we have to wait? The father has been living in Seattle Washington off and on and is currently living there now and ever since she was 11 months old and recently is just now ''trying'' to act like he wants to be apart of her life only because we are moving. He has not once and I repeat not once, shown up to the custody hearing or the child support hearing. He is supposed to pay weekly and hasn't paid one cent and owes back child support also.

Re: Moving out of State
I think your girlfriend is doing the right thing.
How much money is owed in back support? Maybe you can work out a deal where you waive all back support in consideration of his waiving all parental rights to the child.
