Moving out of State

I reside in NY, and have joint custody for my son. I was wondering if there were any parental rights to move out of state, or what course of actions I could take.

If you have physical custody of the child, and moving out of state will affect the visitation rights of the othe parent, you would have to receive written consent from the parent before making the move.

If you do not receive consent, you would have to make application to the Family Court to allow you to make the move. You would have to demonstrate to the Family Court that the move is necessary and that it is in the best interests of the child.
