Legal Question in Family Law in New York

MTA pension

My husband early retired in 1993 after working for 20 years. We were married for 11 years when he retires & 19 years when he died in 2001. Is his exwife entitled to any part of this MTA pension. The divorce decree dated 1981/82 said she was not entitled to his pension. She is receiving part of the RR Retirement pension and part of the MTA pension. I want to know if this is legal. I was married to him for 19 years when he died.

Re: MTA pension

The ex-wife's rights would be determined by the settlement agreement and/or divorce decree at the time, and any Domestic Relations Orders that may have been entered.

Without knowing all of the relevant dates and the wording of the various documents and decrees it is impossible to offer a more precise answer to your question.
