Legal Question in Family Law in New York

Non-Custodial Parent Moving

Non-custodial parent is moving two hours away. Do I have any rights to know where he is moving, living conditions in the home (sleeping arrangements for the kids) and what other adults will be living in the residence? Can I prevent them from going to visit if severe weather may prevent them from returning on Sunday so they can get to school on Monday?

Re: Non-Custodial Parent Moving

You have the right to know that they are not in an unsafe apartment, but the burden would be on you to show the dangerous situation. While in an emergency I imagine it would be in the best interest of both parents that their children are safe, I am afraid the threat of bad weather is not enough to impede visitation, if it becomes a habitual issue you may need to go to court to clarify the matter.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.
