Legal Question in Family Law in New York

Non-custodial parental rights

My son's mother is trying to move to FL. We were in the process of setting up a custodial agreement for my son to live with me full time, and now she changed her mind and wants to move. I do not have custody. We were never married. I am listed on the birth certificate. Can she legally take my son and move to FL?

Re: Non-custodial parental rights

You need to go to Family Court and file a petition to prevent her from moving.
