Non-Legal Separation and COBRA Medical Coverage

My husband separated from the marriage over a year ago, not legally. He has provided my medical coverage through his employer for 16 years since married. He has left his employment this month and has told his employer that he is not keeping coverage under COBRA. However, he has said many times and I was just told by an insurance broker that legally he MUST provide my medical coverage. I have a rare chronic illness, was very, very sick for about 12 years and was even going to go on Perm Disability. We had always kept my medical with him as I was unable to work at jobs, had to leave and never could rely on me keeping a job and then not being able to afford coverage. I hve already given a lawyer $3500 for a separation and never got it as my husband dragged me in and out of court, with his lawyer NEVER showing up and the lawyer drained the money with his preceense in court. Now I have nothing to show for it. My husband has left with no phone #, no address, no nothing. He even did not advise our lawyer from sale of house with money in escrow that he was leaving and possibly leaving the state. Please tell me if I have a leg to stand on?

It sounds like you really need legal representation. If you cannot afford it, I suggest you contact a legal aid organization such as Nassau/Suffolk Law Services Committee. Here is the link:
