Legal Question in Family Law in New York

Non-payment of child support after separation stipulation

My ex hand I entered into a seperation agreement June 06, I bought him out of our business with cash and a small note, and bought him out of our home with a credit to him of child support payments for the next three years until he is paid off and then he has to send regular child support pymts. His only responsibility is childcare exp, etc.. (70%) each month. He does not work and the 125k I gave him was from a refinancing of my home to buy him out of the business. While I have paid him each month on time for the business as well as his health insurance, he refuses to pay any childcare expenses that he agreed to. He is in arrears of about 9k. I had to let my lawyer go - as his bill reached 70K (I still owe 13k) I am stuck - I don't qualify for poor person status - but my financial situation is horrendous, I have very little $ to live on, I will lose my business if I take any more debt, I am the custodial parent and supporter. Any retainer is not an option for me. There are harassment issues, orders of protection, etc. I am afraid at this point and do not know what to do, I have searched everywhere online. The divorce decree is not final yet. Is there anyone out there that can give me some suggestions?? Thank you in advance. NY

Re: Non-payment of child support after separation stipulation

Depending on the language of the separation agreement, you may be able to enforce the child support provisions in several ways. I would need to review the agreement that was filed, as well as all of the other relevant papers and information. Feel free to call my office to discus this further; I will not charge you a consultation fee, and I will consider taking your case pro bono or with the expecation of collecting fees from your ex.
