Ny Divorce & Grounds
Me and my husband started living apart in Sep 2005. He filed for divorce in May 2006 with abandonment (as in I abandon him)as grounds. I was pregnant and my child was born in May 2006. Does he have grounds?

No. Abandonment (actual or constructive) must be for 1 year BEFORE you file for divorce.

No, the abandonment must be for one year or more. He filed when it was only 8 months. Please consult with an attorney regarding your rights as far as child support, maintenance, etc. Feel free to call or email us... our fees are very low.
