NY-Writ of Garnishment Information Needed

I am in need of information on how to garnish my ex-husbands wages, to cover child support. Do I have the check go directly to the court and then to me, or can I get a check directly from his check each month?

The Virginia legislature has expressed a strong preference for child support payments to go through the Division of Child Support Enforcement, rather than directly to you. You can waive that, but it might not be a good idea; DCSE has a fair amount of power to find him if he changes jobs, and will do that for you.

In New York all you need to do is go before the child support collections unit (SCU) and ask for an order giving you direct deduction of his child support from wages. The checks get sent to SCU and then on to you - this allows you to keep a certified court record on his payments. SCU will maintain these records and attend hearings if need be! Good luck!
